1. Introduction

Welcome to SimpleVids ("SimpleVids," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our AI-powered video creation services, including our website (simplevids.com), mobile applications, and related services (collectively, the "Services"). By creating an account, generating videos, or otherwise using the Services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Services. We may update these Terms from time to time, and continued use after changes constitutes acceptance. Please review them periodically.

These Terms comply with Romanian law, including the Civil Code and consumer protection regulations, as well as EU directives on digital services.

2. Acceptance of Terms

These Terms form a binding legal agreement between you and SimpleVids. You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent that you meet these requirements and have the authority to agree to these Terms.

If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. User Accounts

To access certain features, you must create an account with accurate information. You are responsible for:

  • •Maintaining the confidentiality of your login credentials.
  • •All activities conducted through your account.
  • •Notifying us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Description of Services

SimpleVids provides an AI-powered platform for generating videos from text prompts, including features like stock footage integration, voiceovers, captions, and social media exports. We strive to make the Services reliable, but we do not guarantee uninterrupted or error-free operation.

The Services may evolve, and we may add or remove features at our discretion.

5. User Content and Generated Videos

You retain ownership of your text prompts and generated videos ("User Content"). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • •Host, display, and process it to provide the Services.
  • •Use anonymized data to improve our AI models.

You represent that your User Content does not infringe third-party rights and complies with our Content Guidelines.

We own the AI technology and stock assets used in generations; you receive a limited license for personal/commercial use based on your plan.

6. Prohibited Activities

You agree not to use the Services for any unlawful or harmful purpose. Prohibited activities include:

  • ✗Generating or distributing illegal, defamatory, or harmful content (e.g., hate speech, deepfakes without consent).
  • ✗Violating copyrights, trademarks, or privacy rights of others.
  • ✗Using the Services to spam, harass, or conduct fraudulent activities.
  • ✗Attempting to reverse-engineer or scrape the Services.

Violations may result in account suspension, content removal, or legal action.

7. Payments and Subscriptions

Paid plans are billed automatically on a recurring basis. You authorize us to charge your payment method. All fees are non-refundable except as required by EU/Romanian consumer law (e.g., 14-day withdrawal right for new subscriptions).

  • •Taxes: You are responsible for applicable taxes (including VAT).
  • •Cancellations: Stop future charges via your account settings; no prorated refunds except where required by law.
  • •Disputes: Contact us before disputing charges; we offer mediation under Romanian consumer protection rules.

We use third-party processors (e.g., Stripe) for secure payments.

8. Intellectual Property

SimpleVids and its licensors own all rights to the platform, AI models, stock assets, and trademarks. You are granted a limited, revocable license to use the Services for your permitted purposes. You may not remove any proprietary notices.

Generated videos are yours to use commercially (per your plan), but you must comply with attribution requirements for stock assets if applicable, in line with EU copyright law (Directive 2019/790).

9. Termination

You may terminate your account at any time. We may terminate or suspend access for violations, with or without notice. Upon termination, your right to use the Services ends, but Sections 5-18 survive. EU consumers have withdrawal rights for paid services.

10. Disclaimers and Limitation of Liability

The Services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including for accuracy of AI outputs.

To the fullest extent permitted by Romanian law, SimpleVids shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the fees paid by you in the past 12 months.

11. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Bucharest, Romania. EU consumers may also use alternative dispute resolution (ADR) via the European Online Dispute Resolution platform.

12. Miscellaneous

These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement.

  • •Severability: Invalid provisions do not affect the rest.
  • •Waiver: No waiver unless in writing.
  • •Assignment: We may assign these Terms; you may not without consent.
